Peru operates a licensing system for both land-based and online gambling, supervised by the Ministry of Foreign Trade and Tourism (MINCETUR). Casinos and slot machine halls have been regulated since 1999 under Law No. 27153. Online casino games and sports betting, which for years were offered to Peruvians mainly by companies based abroad, have been regulated since February 2024 under Law No. 31557, as amended by Law No. 31806, and its implementing regulation, Supreme Decree No. 005-2023-MINCETUR. Operators, whether Peruvian or foreign, need a MINCETUR authorisation, pay a 12% tax on net revenue and must observe rules on player identification, advertising and responsible gambling. Unlicensed platforms can be blocked, and running them is a criminal offence. This guide explains the framework, how it is enforced, the position of players, taxation and the main protection tools.

Historical development

Peru’s modern gambling law began with land-based gaming. Law No. 27153, published on 9 July 1999, treated casinos and slot machines as part of tourism policy and placed them under the tourism authority. The law confined casinos to four- and five-star hotels and five-fork tourist restaurants, required a distance of at least 150 metres from places of worship, schools, barracks and hospitals, and barred minors from gaming venues. That authority is now exercised by MINCETUR through its Directorate General of Casino Games and Slot Machines (Dirección General de Juegos de Casino y Máquinas Tragamonedas, DGJCMT).

Online gambling remained outside this framework for two decades. Websites and apps offering sports betting and casino games, many of them run from abroad, served Peruvian customers without a Peruvian licence and without paying Peruvian gaming tax. Shortly before the regulated market opened, MINCETUR stated that it had identified 115 companies offering such services, 86 based abroad and 29 in Peru, according to the official newspaper El Peruano (6 February 2024). iGaming Business reported an estimate of PEN 3.8 billion in bets placed in 2022.

Congress responded with Law No. 31557, published on 13 August 2022, which regulates “remote games” (juegos a distancia, meaning online casino-type games) and “remote sports betting” (apuestas deportivas a distancia). Before it took effect it was substantially revised by Law No. 31806, published on 28 June 2023. The implementing regulation followed on 13 October 2023, and the regime entered into force in February 2024.

Checking gambling legislation and licensing

Peru is a unitary state, and gambling is regulated at national level. The key instruments are:

  • Law No. 27153 (1999), the law on the operation of casino games and slot machines, as amended. It covers land-based casinos and slot machine halls.
  • Law No. 29907 (2012), the law on the prevention and treatment of gambling addiction (ludopatía) in casino and slot machine halls. It underpins the register of persons barred from entering gaming venues.
  • Law No. 31557 (2022), which regulates remote games and remote sports betting. It sets the authorisation regime, operator duties, prohibited participants, the special tax and the sanctions framework.
  • Law No. 31806 (2023), which amended Law No. 31557. A consolidated text is published by Congress.
  • Supreme Decree No. 005-2023-MINCETUR, the regulation of Law No. 31557, published on 13 October 2023.
  • Legislative Decree No. 1644 (2024), which extended the Selective Consumption Tax to remote games and betting, and Supreme Decree No. 008-2025-EF, which set the rates.

According to the Lima law firm Payet, Rey, Cauvi, Pérez, Law No. 31806 made several significant changes. It widened the permitted domain extensions, replaced the original guarantee with a larger one, expanded the definitions to include skill games and e-sports, confirmed that foreign companies are taxpayers, and amended Article 243-C of the Penal Code so that it covers organising or operating remote games or betting without meeting the legal requirements.

Two categories of activity can be authorised. MINCETUR’s official FAQ lists “remote games” as slots, casino games, skill games and progressive systems, and “remote sports betting” as bets on sporting events, e-sports, virtual events and fantasy games.

Regulator and licensing model

Peru follows a licensing model: there is no state monopoly, and any qualifying company may apply for authorisation, with no fixed cap on the number of operators. Law No. 31557 gives MINCETUR responsibility for the regulation, authorisation, revocation, supervision and sanctioning of remote gaming, a role exercised by the DGJCMT. The same directorate oversees casinos and slot machine halls under Law No. 27153.

The main features of the authorisation regime are:

  • Eligible applicants. According to the MINCETUR FAQ, applicants must be companies incorporated under Peru’s General Companies Law or branches of foreign companies with a representative registered in Peru. Natural persons and single-owner businesses are excluded.
  • Duration. According to a guide by the law firm Estudio Llona & Bustamante, an operating authorisation lasts six calendar years and the registration of a technological platform two years, both renewable.
  • Guarantee. Operators must lodge a guarantee in favour of MINCETUR equal to the greater of 3% of annual net income or 600 tax units (UIT). The UIT (Unidad Impositiva Tributaria) is a reference value set each year; Payet, Rey, Cauvi, Pérez put 600 UIT at about PEN 2.97 million in 2023.
  • Technical standards. Game programs must offer a theoretical return to player of at least 85%, and games and platforms must be certified by laboratories accredited by MINCETUR.
  • Domains. The original Law No. 31557 required platforms to operate only under the .bet.pe extension. Law No. 31806 relaxed this: the domain may now end in .bet.pe, .bet, .com, .pe or .com.pe.
  • Payments. Cryptocurrency transactions are prohibited.

The application process opened on 13 February 2024. Companies already active were given until 13 March 2024 to apply if they wished to keep operating while their applications were assessed. According to Yogonet, reporting statements by the then Minister of Foreign Trade and Tourism, Juan Carlos Mathews, 145 companies applied in that window. In the same period 144 linked service providers registered, 7 international certification laboratories were accredited, and 184 applications were filed for the approval of platforms, game programs and progressive systems.

By October 2024 trade press reported that 67 brands belonging to 64 companies had been authorised (Focus Gaming News). In May 2025 iGaming Business reported 60 authorised platforms and 280 registered service providers. The head of the DGJCMT, Yuri Guerra, cited the same figures in a December 2025 interview with Yogonet, together with 9 accredited laboratories and 5,785 registered sports betting venues. The authoritative and current list is MINCETUR’s register of authorisation holders.

Online gambling: what is permitted and how it is enforced

Online casino games on mobile devices

Online casino games and sports betting are lawful in Peru when offered by an operator holding a MINCETUR authorisation through a registered technological platform. Players must be adults and register an account with an identity document: a national identity card (DNI), a foreigner’s card or a passport, according to the MINCETUR FAQ. Physical betting venues linked to these operators may offer only sports, e-sports, virtual sports and fantasy betting, not online casino games.

Enforcement against unlicensed operators takes several forms:

  • Administrative sanctions. The regulation sets out a table of infractions with penalties ranging from a warning to fines of up to 200 UIT, and cancellation or disqualification for up to ten years or permanently (Estudio Llona & Bustamante). Before the market opened, MINCETUR warned that companies continuing to operate without authorisation would face fines of no less than 150 UIT, criminal action and disqualification (El Peruano, 6 February 2024).
  • Blocking. “Blocking” means directing internet service providers to make a website or app inaccessible. The regulation allows MINCETUR to order the blocking of IP addresses, URLs, web pages and applications. In practice the DGJCMT acts in coordination with the Ministry of Transport and Communications (MTC).
  • Criminal law. Article 243-C of the Penal Code, as amended by Law No. 31806, punishes organising or operating remote games or betting without meeting the legal requirements with one to four years’ imprisonment, a day-fine and disqualification.
  • Advertising. According to CMS, advertising for operators without MINCETUR authorisation is prohibited. Advertising by authorised operators may not include minors or messages aimed at children.

Blocking has accelerated in 2026. In July 2026 MINCETUR reported blocking 36 unauthorised platforms and seizing 39 clandestine slot machines (Yogonet). On 2 October 2026 El Peruano reported a further 50 blocks, bringing the total to 86 platforms, out of 157 scheduled for blocking during the year. The DGJCMT said it holds a database of about 2,000 domains compiled from lists of illegal sites and had carried out 4,572 inspections of technological platforms and betting venues. In May 2025 MINCETUR claimed that regulation had cut the supply of illegal online gambling by 40% and that 15% of illegal sites had left the market (iGaming Business); these are the regulator’s own estimates and have not been independently verified.

Position of players

The penalties described above are aimed at those who organise or operate gambling. Article 243-C of the Penal Code targets organising, conducting or operating games without authorisation, and the administrative sanctions apply to operators. We found no provision in the sources reviewed that makes it an offence for a player to use an unlicensed website, and no reported case of a player being prosecuted or fined for doing so.

That does not mean unlicensed play is protected. A player using an unauthorised site has none of the safeguards of the regulated market: no MINCETUR oversight of payouts or game fairness, no guarantee lodged with the state, and no link to the national exclusion register. Under Law No. 31557, certain people may not take part in licensed remote gambling at all. These include minors, sports participants able to influence results, MINCETUR officials, the operators’ own staff and management, and people registered as prohibited.

Taxation

Operators

Law No. 31557 created a special tax on remote games and remote sports betting (Impuesto a los Juegos a Distancia y Apuestas Deportivas a Distancia), administered by the tax authority SUNAT. According to SUNAT’s guidance:

  • the rate is 12% (Article 42 of the law);
  • the base is net income, meaning bets received minus prizes and refunds, less a 2% deduction for maintenance expenses (Article 41);
  • both Peruvian companies and authorised foreign companies are taxpayers. Foreign companies register for a taxpayer number (RUC) online, file monthly and may pay in soles or US dollars.

The tax has applied since 1 April 2024. According to the law as published in 2022, the revenue, after administration costs, is shared as follows: 20% to the Treasury, 20% to the Ministry of Health for mental health programmes, 40% to MINCETUR (part for enforcement and part for tourism) and 20% to the Peruvian Sports Institute. Before launch MINCETUR estimated annual revenue of about PEN 162 million (El Peruano, 2024).

In addition, Legislative Decree No. 1644 (13 September 2024) extended the Selective Consumption Tax (Impuesto Selectivo al Consumo, ISC), an excise duty, to remote games and betting. It is charged on the value of each bet. Supreme Decree No. 008-2025-EF set a transitional rate of 0.3% until 30 June 2025 and 1% from 1 July 2025 (Gestión, 19 January 2025). Domestic operators pay it themselves; for platforms run by foreign companies the player is the taxpayer and the operator withholds the tax when the bet is placed, identifying Peruvian players by IP address, SIM card, Peruvian payment card or registered address, according to SUNAT.

Land-based casinos and slot machine halls pay a separate tax under Law No. 27153. Originally set at 20%, it was reduced to 12% by Law No. 27796, which also changed the base to net income less maintenance expenses, as summarised by SUNAT.

Players

SUNAT states that players are not taxpayers for the 12% tax on remote games. Players betting with foreign-based platforms do, however, bear the 1% ISC described above, which is withheld from each bet. We could not find an authoritative SUNAT source on whether, and how, an individual’s net winnings from licensed online gambling are subject to personal income tax. Players with significant winnings should seek advice from SUNAT or a tax adviser.

Consumer protection and responsible gambling

The main protection tools are:

  • Age limit. Only adults (18 and over) may play, both in venues under Law No. 27153 and online under Law No. 31557. Online operators must verify identity and age at registration.
  • Exclusion registers. Under Law No. 29907, MINCETUR keeps a register of persons barred from entering casino and slot machine halls, which people can join voluntarily for a minimum of six months, renewed automatically for equal periods, or be entered at a family’s request after a medical assessment. The procedure is available on the gob.pe portal. Law No. 31557 bars people on the prohibited persons register from remote gambling, and MINCETUR’s FAQ confirms that self-excluded players are kept in a register of prohibited access that operators must respect. Requests are handled by the DGJCMT.
  • Operator duties. The regulation lists responsible gaming among its aims. Operators must verify identity, return account balances, give MINCETUR audit access to their platforms, and display warnings in betting venues, such as “Excessive sports betting can cause gambling addiction”. We could not verify a statutory requirement for deposit or time limits in the sources reviewed.
  • Funding for treatment. One fifth of the remote gaming tax is earmarked for the Ministry of Health’s mental health programmes.

Treatment is provided through the public health system. The Ministry of Health (Minsa) reported in December 2024 that its facilities had attended 11,349 cases of pathological gambling, 32% of them adolescents aged 12 to 17 (Crónica Viva). Recent and upcoming developments

  • ISC changes approved, then observed (2025). In June 2025 Congress approved Bill No. 9645/2024-CR. It would limit the ISC base to cash bets, excluding free bets, allow natural persons with registered businesses to operate, and make match-fixing a crime punishable by 4 to 12 years in prison (Gestión, 12 June 2025). The Executive returned it with objections in July 2025, arguing that the ISC burden would fall by 90% to 95%.
  • Bill reactivated (2026). Congress reactivated the measure on 28 September 2026 as Bill No. 00389/2026-2031-CD. According to Focus Gaming News, the Ministry of Economy and Finance estimates it would reduce annual ISC revenue from PEN 284 million to between PEN 14 million and PEN 28 million. The bill is pending; the 1% ISC remains in force.
  • Proposed advertising ban. Bill No. 13265, filed by Congresswoman Susel Paredes in November 2025, would ban all gambling advertising, including by licensed operators, and repeal the provision of Law No. 31557 that allows it (Infobae). We found no record that it has been approved.
  • Enforcement. MINCETUR blocked 36 platforms in July 2026 and a further 50 by 2 October 2026, a total of 86, with more scheduled for blocking before the end of the year.
