Court Revokes Dragonara Gaming Injunction

d casinoIt was announced that the request made by Dragonara Gaming Limited was considered to be groundless and the court rejected the appeal. The company required a warrant of prohibitory injunction.

What made the company managers take these measures was the fact that the authorities have decided to give Eden Leisure Group the opportunity to run a casino venue.

The judge who was in charge of making the decision, Judge Joseph R. Micallef, said that the previous warrant had to be revoked, due to the fact that according to convincing proof, Dragonara had a certain legitimate interest. In addition, the request for injunction was not supported by proven facts that could serve as an evidence in court.

The Judge commented on the case and said that the matters have reached the point when they cannot be improved unless the court is involved.

Judge Micallef also reminded that according to the current laws, Dragonara has the freedom to take up legal actions in order to protect its rights. However, the warrant request they made should not have been among the actions that were worthy of taking.

In addition, the court authorities added that at this stage of the concession, every decision made can be cancelled or changed. They also said that Dragonara’s worries were not going to come true. What is more, if they were about to materialize, that would result in cancellation of the bidding procedures planned.

Having said that, the court representatives added that despite the fact that the request was revoked, the other parties should not regard it as an opportunity to do whatever they want. The court said that all of these – the Ministry of the Economy, the Ministry of Finance, the Privatisation Unit and small business, should keep it in mind that for the time being, courts’ decisions can easily be altered.

The decision taken a few days ago might not be the final one. A new investigation may be conducted and new legal procedures may be applied.

Dragonara Gaming has been awarded a license that allows the company to freely operate the famous Dragonara Casino, located at St Julians. Company’s managers took matters to court a few weeks ago and claimed that there were some details about the proposal of Eden Leisure Group, which needed to be reconsidered. Once these flaws were corrected, Eden Leisure Group would not have been chosen for a preferred company during the concession.

Dragonara Gaming disagreed with the decision and announced that the up front cash offer was several times bigger than the sum, proposed by Eden.
